Information clause on processing of personal data


In fulfilling the obligation to provide information arising from laws and regulations of the European Parliament and the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) (“GDPR”) I hereby inform that:

The Administrator of your personal data is PBS IT Sp. z o.o., based in Odrano–Wola (05-825), Błękitna 21C, a company entered into the Register of Entrepreneurs of the National Court Register kept by the District Court for the Capital City of Warsaw, XIV Commercial Department of the NCR under number 0000382284, NIP (Tax Identification Number) 5291793780, REGON (National Business Registry Number) 142876771, and PBS IT Sp. z o.o. based in Odrano–Wola (05-825), Błękitna 21C, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court for the Capital City of Warsaw, XIV Commercial Department of the NCR under number 0000675024, NIP (Tax Identification Number) 5291816506, REGON (National Business Registry Number) 367120599 (“Administrator”).

The Administrator is processing your personal data in connection with the execution/negotiation of the agreement concluded by the Administrator and your Employer (principal/recipient), in virtue of designating you as a person entitled to contact the Administrator on current issues regarding the execution/negotiation of the agreement.

The Administrator is processing your personal data pursuant to Article 6, paragraph 1, letter f of the GDPR – an indispensability of personal data processing to fulfil objectives arising from the legitimate interests pursued by the Administrator or your Employer – for the following purposes:

The Administrator is processing personal data that were transmitted directly by you or your Employer. The Administrator is processing the following data categories: :

Yur personal data may be transferred by the Administrator to other entities providing services in the interest of the Administrator (e.g. IT services), and to entities for which the Administrator is legally obliged to provide personal data processed.

The Administrator will not transfer your personal data to third countries or international organisations.

The Administrator will be processing your personal data over the term of the agreement concluded by your Employer, and after the expiry date, over a period necessary to secure or pursue potential claims available to the Administrator, and to defend against potential claims – no longer than until their limitation period expires, or until the valid termination of the proceedings, which they are subject to.

Providing the personal data by you is voluntary, however it opens a possibility of getting into touch with you by the Administrator, following the process of concluding or performance of an agreement by your Employer. Refusing to provide personal data or demanding them to be removed prevents the Administrator from contacting with you.

In addition to the powers referred to in point 9 above, at any time you have the right to raise objections against the processing of your data, processed for the purpose arising from legitimate interests pursued by the Administrator or your Employer. The Administrator will cease processing your personal data, unless the Administrator can show that there are valid, legally justified grounds which have priority over your interests, laws and freedoms, or your data will be crucial for potential determining of, pursuing or defending against any claims.

The Administrator informs that will not process your personal data by automated means, will not make decisions by automated means on the basis of the personal data processed by the Administrator, and your personal data will not be profiled or processed by the Administrator for marketing purposes.
